Young mum wins compensation after being sacked for refusing to get abortion

Teri Cumlin, a charity worker from Glasgow who was employed by Engage Fundraising, was told by her boss, Mark Robertson, that she would lose her job if she did not have an abortion. He was quoted as telling her “If you want a career then I’d advise you to terminate your baby”, adding “do you wish to be the kind of person who has different children to different fathers?”.

Ms Cumlin was eventually sacked two months before she gave birth, and took Engage to an employment tribunal for unfair dismissal, sex and pregnancy discrimination. She explained to the court that she had had a stillborn previously and there was no way that she was having an abortion. When she started crying her boss told her she was making herself cry, telling her it was all her fault.

Ms Cumlin was also demoted from her team leader role because of her pregnancy, and complained to her head office but no steps were taken to address the issue. When she was suspended for claims of misconduct last year, she was told not to contact anyone at Engage while they investigated. A week later she attended the office and was dismissed.

She suffered high blood pressure during pregnancy and had to have an emergency caesarean section one month early. Her son was in intensive care for a week, and Ms Cumlin believes the stress caused by her former boss led to these problems arising.

The court awarded Ms Cumlin £12,000 in compensation.

Former olympian awarded compensation after crash ended 2012 dreams

A two-time Olympic swimmer has been awarded compensation following a car crash which left his 2012 London games ambitions in tatters.

200m breaststroke swimmer Andrew Bree, from County Down, represented Ireland at the 2000 and 2008 Olympics. He was at one point ranked 15th in the world, and was aiming for his third Olympics before being involved in an accident in Belfast.

Due to recovery he was not fit enough to make the qualifying time three months later after training in the US. Mr Bree sued the other motorists insurers for the cuts to his funding grants when he failed to qualify for the games.

The court heard that Mr Bree had aimed to finish his career at the London Games, which was then stopped by his accident. Due to this, he over-pushed himself in his efforts to get fit enough to qualify after his injuries and suffered a new leg injury as a result.

Mr Bree was awarded compensation of £25,000 for his injuries and loss of funding from two Irish sporting bodies. He has remained in the sport and looks to develop himself as a professional coach.

Alton Towers accepts full liability – will likely pay millions in compensation

Furthering on from our recent article regarding the horrific rollercoaster collision at Alton Towers, it looks like the parks parent company, Merlin Entertainment, is set to pay out millions in compensation as it has accepted full responsibility for last weeks tragic accident, according to this report by the Metro.

The company released a statement saying it will ensure full compensation is given to all injured passengers involved in the Smiler ride crash on 2nd June, which saw 16 people injured, 5 of which were hospitalised.

Tragically, the youngest victim, 17 year old Leah Washington, who was on her first date with boyfriend Joe Pugh, sustained such severe injuries to her left leg that it had to be amputated above the knee. Pugh, 18, was also seriously injured in the incident and remains in hospital with two broken knees and severe hand injuries.

Leah’s father issued a statement on behalf of the family that stated:

“We would like to thank our family, friends and all the well-wishers for their support. Leah has suffered a life-changing injury and now has many months of rehabilitation ahead of her.

We would like to thank all the emergency services at the scene and the hospital staff who saved Leah’s life.”

Alton Towers has released a formal admission of liability for the incident and has advised the victims to hire a lawyer so a compensation agreement can be reached. Alton Towers representatives were sent to deliver the letters detailing the parks acceptance of full responsibility to the victims families.

The statement goes:

Since the accident of last Tuesday we have done our best to provide appropriate communication and support to those involved and to their families.

We absolutely recognise what a difficult time this is for everyone, especially those who have been so seriously injured… Irrespective of the outcome of current investigations into the causes of the accident, in these letters we have accepted full responsibility to those who had been injured in the accident and confirmed that we will ensure that compensation will be provided to them.

Alton Towers victims could receive ‘hundreds of thousands’ in compensation

(Image courtesy of IB Times UK)

Rescue services at the scene of the accident (Image courtesy of IB Times UK)

The four people injured in Tuesday’s horrific rollercoaster accident could be in line for hundreds of thousands of pounds in damages, reports IB Times UK.

Two men aged 27 and 18, and two women aged 19 and 17, suffered serious leg injuries in a collision involving two carriages on the Smiler ride, the theme parks flagship rollercoaster. Twelve other occupants of the ride were treated for neck and abdominal injuries.

One of the four seriously injured has already been discharged from the major trauma centre at Royal Stoke University Hospital, but the other three are still being monitored. IB Times states that they could be in for “very significant payouts”.

Reports that one of the four may have their leg amputated means that individuals claim may be up to £111,000, as according to the Judicial College Guidelines, the range of damages for one leg amputated below the knee is between £79,000 and £107,000. Above the knee increases that figure to between £85,000 and £111,000.

The ride – which holds the Guinness World Record for most loops in a rollercoaster – has been plagued with technical problems since it was opened to the public in 2013. According to visitors on the day of the accident, it had even broken down just hours before the crash.

Payouts to victims would be agreed between Alton Towers operator Merlin Entertainment and the victims, although if they deny culpability, it will be taken before a judge.

Top tips to stay safe on the road in hot weather

carsun

British sunseekers rejoice! Well, hopefully anyway. Media outlets have been reporting today on the projected “Iberian heatwave” that the UK is set to experience, and while we don’t want to get hopes too high (being cynical about a sunny summer is about as British as queuing) if it does go to plan we are in for a toasty week at least, with temperatures set to creep up to 27C.

With that in mind, the potential of such highs aren’t without their risks. Being inside a car on a hot day is a terrible situation, and so we have compiled a short list of the risks and ways you can keep yourself safe this summer to avoid any possible road accidents:

Heatstroke/Heat exhaustion – This can be brought on by a loss of body fluids and salts through sweating, which can make you feel tired and faint. If you suffer from diabetes, kidney or heart problems you may be at greater risk. Drink plenty of water. Make sure your car is stocked up on water before you leave in case you break down and are stranded.

Road surface melting – in hot temperatures the overbanding and tar on roads can melt slightly, leaving them slick and uneven. Always be aware of this and concentrate when driving.

Ventilation – keep your vehicle well ventilated so you avoid drowsiness and are comfortable, keeping you alert.

Brightness – It’s very possible that you may be dazzled by bright sunlight, whether it is reflected at you from another car’s mirror or it is a very clear day. Don’t drive too fast and if need be, pull over.

Oil – It sounds obvious but make sure you have enough oil in your car. It not only lubricates your engine but it actually helps keep it cool.

Air Conditioning – If you do have A/C in your car it is important to remember it will not work properly if you have your windows open too.

We hope you’re never involved in a road accident, but if you are, it is important to be aware there are reputable legal experts who can help. KLS Law and our team of specialist road accident solicitors have over 25 years experience helping clients receive the compensation that they deserve.

If you have been the victim of a road accident and it wasn’t your fault, you may be entitled to claim. Our personal injury solicitors can represent and guide you through the complex legal process.

We offer a free, non-persuasive consultation for you claim and guarantee it will be handled by one of our professional, legal experts. We will deal with your claim on a No Win No Fee basis and arrange insurance to cover you for third party costs.

Tobacco giants ordered to pay $15.6bn in compensation

shutterstock_196890071

CANADA: In business legal news today, in a landmark ruling, three tobacco giants have been ordered to pay an astronomical total of Can$15.6bn in compensation –  the largest award in Canadian history.

British American Tobacco’s Canadian subsidiary has been ordered to pay Can$10.5bn (£5.5bn) to almost 1 million smokers who claimed that they were not appropriately warned about the health risks involved with smoking.

Imperial Tobacco Canada, which is owned by London based BAT, Benson & Hedges and JTI-MacDonald, was found liable for moral and punitive damages. All three companies have stated that they will appeal the ruling. The judgement stated that if there was an appeal, the defendants would have to pay a “provisional execution order” of Can$1.1bn, with Imperial Tobacco Canada paying Can£743m of the order.

The lawsuits behind the award were originally filed in 1998, representing hundreds of thousands of people who were unable to quit or suffer throat or lung cancer, or emphysema. They argued that the companies were negligent in warning customers about the dangers of smoking, failing in their duty to “not cause injury to another person”, according to the court.

The firms have also been accused of destroying relevant documents to the case and of unscrupulous marketing.

Japanese court awards teachers millions for refusing to sing national anthem

Tokyo District Court (Image courtesy of Wikipedia)

A Japanese court has awarded millions in compensation to a group of teachers who were punished for refusing to sing the country’s national anthem.

The Tokyo District Court ruled that the capital’s municipal government has to pay the group of 22 former high school teachers the huge total of 537 million yen (roughly £2.8 million).

The group of teachers refused to sing the Japanese national anthem as they condemned nationalism in education. Critics of the anthem believe it calls to sacrifice oneself for the emperor and celebrates militarism. The group have stated the city of Tokyo refused to hire them because they disobeyed orders to stand and sing the anthem at graduation ceremonies.

This is not the first instance of a case of this type. In 2012 the Supreme Court ruled that penalising teachers for refusing to sing the national anthem was constitutional, although stressed that administrators exercise care in going beyond a reprimand.

Plaintiff Eishun Nagai, 68, said of the outcome of the: “It is a great ruling that gives teachers some breathing room.”

Asbestos shovelling competition led to death by industrial disease

A chilling image has surfaced of Australian miners partaking in an asbestos shovelling competition in the town of Wittenoom.asbestosThe photograph, taken in 1962, shows the men shovelling mounds of raw blue asbestos, thought to be over 100 times more hazardous than the regular white asbestos, into drums as the fatal minerals waft through the air.

Tragically, all of the men pictured bar one died from asbestos triggered cancer. Some of them also lost their children through exposure.

The town of Wittenoom was a hub of blue asbestos production in Australia before health concerns were realised and it was shut down. Asbestos was uses on the roads, pavements, and playgrounds of the town, with children allowed to play freely in “asbestos pits”. Over 2000 former residents and workers died due to asbestos exposure.

According to Robert Vojakovic, president of the Asbestos Disease Society, the dangers of the minerals were made clear before the image was taken, although mining companies kept it under wraps to continue work.

Thousands of former workers have now sued the mining company, CSR, for industrial disease compensation.

If you have suffered because of an industrial disease caused by your work, you are entitled to claim for compensation.

Earlier this week a woman won her right to claim for compensation after she was hit by an insured driver whilst on holiday, resulting in her leg being amputated.

Tiffany Moreno, 29, from Barry, Vale of Glamorgan, was holidaying on the Greek island of Zakynthos when she was struck by a car as she stood on the kerbside of a road. The damage was extensive and she had to have her right leg amputated just below the knee, while also suffering severe ligament damage in her left leg.

It emerged that the driver was uninsured and a judge at London’s High Court deemed the Motor’s Insurers’ Bureau (MIB) liable to compensate Mrs Moreno under European Law.

The MIB admitted liability however insisted that her damages payout be calculated under Greek law as the amounts are much lower there. The judge presiding, Mr Justice Gilbart ruled that the law of England and Wales should be applied to Mrs Moreno’s case.

If you have been involved in an accident that has led to a personal injury however serious, and it wasn’t your fault, you may be entitled to claim for compensation.

Mercedes-Benz camera system to reduce cycling risks

Mercedes-Benz have this week been showcasing their latest innovations in vehicles to help reduce the risks of accidents amongst cyclists.

At a convention, the leading German vehicle manufacturer displayed new features in its Econic truck, a vehicle usually used for refuse collections.

The truck had a passenger door that was glass all the way to the bottom, with the reason being that it would allow any cyclists pulling up on the nearside to be visible to the driver. It also boasted a four camera system, with one on the front, back and wing mirrors, feeding a video stream into a large monitor mounted on the dashboard.

Phillip Chance, regional manager of special projects at Mercedes-Benz, explained that the aim is to cut down on the terrible death toll among cyclists in the UK. The Econic truck is an urban vehicle, and the majority of cyclist accidents and deaths happen in urban areas.

Mr Chance also made it clear that it is vital for cyclists to also ensure they are practicing road safety, with a call for more to wear high visibility vests, and to not have headphones in while cycling.

Candy Crush Saga causes man personal injury

A reminder today of the unpredictable nature of accidents leading to injury, after an American man suffered a serious wrist injury due to playing a mobile phone game for two months straight.

The unnamed man was admitted to a hospital in San Diego after complaining of chronic left thumb pain and loss of active motion. It was revealed that he had been obsessively playing the app “Candy Crush Saga” all day for a period of six to eight weeks.

Medical staff diagnosed the man with a tear of one of the two tendons that extends the thumb, believing that he failed to notice the damage initially due to the visual distraction and “highly pleasurable” nature of playing Candy Crush.

An injury can occur at any time, in any place, and it’s important to know that there are professional, friendly people out there who can help should an accident befall you.

Unlike our iPhone obsessive, who probably should have put the phone down, thousands of people suffer personal injuries completely through no fault of their own. But, very much like Candy Crush, it can be incredibly frustrating.

Cycling accidents: Shoulder injury recovery

shutterstock_209499424

If you are a regular cyclist who has been cycling for a long period of time the chances are that you will have come off your bike and suffered an injury of one sort or another. If this has happened there is a high possibility you may have hurt your shoulder. The mechanics of cycle accidents inevitably expose the shoulder region of the body more than any other part (assuming a helmet is worn). Also, the shoulder is not the most naturally protected part of the human body, with less protective muscle fibre, tissue and fat around the exposed bones than most other bony areas.

So it comes as no surprise that so many cyclist accident clients of mine suffer shoulder trauma.

And now I too am in the shoulder trauma cyclist club, having come off my bike on a steep descent near Leek on a Sportive last October, when I broke my collar bone (clavicle) in 2 places and shoulder blade (scapula) also in 2 places.

Being a specialist cyclist solicitor it is part of my job to know about bones, muscles and ligaments throughout the body, but there is nothing better than personal experience to be able to understand the pain and learn the best methods of self-help and treatment. (There is a happy ending to this, I promise. Read on!)

COLLAR BONE/CLAVICLE FRACTURES

The collar bone is a long thin bone that runs from the breastbone to each of the shoulders. Because it is so thin it is easily broken, but collar bone breaks can be very painful. If the bone breaks through the skin (rare), surgery under general anaesthetic will be necessary. Even if it does not, depending on how clean or otherwise the break, surgery with plates and screws inserted may be needed. Fortunately for me my breaks were both clean to both ends of the clavicle and mended without surgery, however I did need quite a lot of strong pain-killing concoctions to get through the pain barrier (especially in the first 6 weeks!).

I was in a makeshift sling for most of this time but was encouraged to mobilise as much as I could, and engaged thoroughly in the physiotherapy regime/weekly intense physio which went on for 4 months then eased off to now to doing self-help mobilisation exercises twice daily.

More about advice in regards to treatment techiques are to follow.

SHOULDER BLADE (SCAPULA) FRACTURES

I also broke my scapula, the shoulder blade – again luckily for me relatively clean breaks but owing to the collar blade fractures compounding the issue it was touch and go whether I would need to be opened up. I am pleased to say now this was not the case. This bone is slightly better protected with muscle fibre and ligaments so a less common injury for cyclists.

HUMERUS (UPPER ARM BONE)

The humerus is the 3rd bone in the shoulder structure and is best thought of as the upper part of the arm. I have acted for a number of clients and still do who have suffered rotator cuff tears. The rotator cuff is a set of muscles and tendons which attach the humerus to the shoulder and help you lift and rotate your arm.

You can have a partial rotator cuff tear or a full tear. A partial tear damages tissues but does not completely sever them. A full tear will detach them completely. A bad fall off the bike could damage the rotator cuff (a very sharp pain in the shoulder socket region is often a tell-tale sign) and very often surgery will be needed to repair/reattach the tendons.

I escaped a humerus break or rotator cuff tear, but apart from my shoulder did suffer multiple other fractures.

BUT now for the good news –

Despite what you might hear even severe shoulder injuries can be treated and will often lead to full recovery, so even if you are in lots of pain and are presently of the view that the chances of you getting back on you bike are as likely as Mark Cavendish winning King Of The Mountains in the Tour, you should in most cases be able to manage it, and possibly come out stronger.

USEFUL TIPS

  1. Engage in full physiotherapy.
  2. Make sure you utilise the services of a top physio who understands cycle injuries. Pick their brains – it is the advice they give not just the manipulation they do which is critical. Don’t rely on an NHS “run of the mill” physio if they are not up to it. Go private if you can-for speed and quality.
  3. Find time yourself during the day for your exercises. I have a busy job but through hard work and discipline maintained the physio for 6 months and am still doing so with good results!
  4. For rotator cuff injuries especially steroid injections can be very helpful and in some cases be a complete cure. Again, if you can, go private.
  5. Ensure you engage a top orthopaedic shoulder surgeon. If you have had an accident and are making a legal claim it is critical your solicitor engages a shoulder expert not just a general orthopaedic surgeon. My 25 years plus of experience in acting for seriously injured cyclist and other clients have taught me this above all else. Sadly too many general orthopaedic surgeons do not sympathise with cyclist clients or do not understand shoulders sufficiently. There are only a handful of top ones I would recommend nationwide.
  6. There is no reason why your solicitor should not be able to organise the whole rehabilitation package for you too. We do and it lifts a huge burden off our clients.
  7. Above all keep a positive and optimistic outlook with clearly defined goals in mind.

AND FINALLY – the good news is with a bit of luck (and if you follow the above tips) that you will be able to get back on your bike much sooner than you think.

The time off cycling will not have weakened your legs too much –I was surprised to find this myself. The muscle bulk you built up pre crash will still be there. I was back on the bike after 4 months and I cycled 60 miles up to 650 metres on 14% gradients last weekend, less than 6 months on from my multiple fracture crash, and booked myself in for a few sportives over the summer too. There is no reason why you can’t do the same.

Top Tips for staying safe on the road during the heatwave

shutterstock_215150509

British sunseekers rejoice! Well, hopefully anyway. Many media outlets have been reporting today on the projected “3 month heatwave” that the UK is set to experience and while we don’t want to get hopes too high, (being cynical about the possibility of a sunny Summer is as British as queuing) if it all does go to plan we are in for a toasty 3 months, with temperatures set to creep up to 28C.

Serious Injury Narrowly Avoided by Jockey

Serious injury was narrowly avoided by Davy Condon, following his fall from Portrait King in the Grand National this weekend

Just three fences from the finishing line he suffered a fall and required medical attention. As the one of the few out of the 39 jockeys who took part, Condon was luck to have escaped serious injury.

For some viewers of the National they won’t have been as lucky.

Each day across the UK someone suffers a serious injury, sometimes within the workplace – just as Condon may have been injured as a result of his work. We all hold our breath and keep everything crossed that the jockeys finish the often dangerous Grand National race safely – but what about those who are seriously injured without the public attention?

Many serious injuries are not as public, but have devastating effects upon those involved and their families.

If you or someone you know hasn’t been as fortunate as Davy Condon, and has suffered  a serious injury you may wish to talk to experts who can advise you on legal issues relating to your injury.

If you have an serious injury issue, contact the serious injury experts at KLS Law  for no obligation, No Win No Fee, legal advice. One of our legal advisors will be happy to help.

Former banker awarded £3.2 million compensation for harassment in the workplace

Road accident claim at KLS Law

Svetlana Lokhova, a former banker in London has successfully won her claim for compensation on the grounds of sexual harassment, after a court ruled the abuse she received affected her psychology and ruined her career in the financial sector.

Mrs Lokhova, a graduate of Cambridge university, worked for the London branch of Russian Bank Sberbank CIB, where she was the only female member of her team. Her ex-colleagues, including her manager David Longmuir, branded her a cocaine addict despite her not taking drugs, as well as stating that she was only hired based on her looks. They described Mrs Lokhova with such derogatory terms like ‘Miss Cokehead’.  She was forced to leave her £750,000 a year role due to the abuse.

Mrs Lokhova has been unable to work for more than three years as she said her reputation had been ‘shredded’. The court accepted that her career in the city was over after reviewing medical evidence.  Mrs Lokhova stated that her position was made impossible and was detrimental to her health, with such instances of harassment as her manager sending an email to a client stating ‘awaiting arrival of Ms Cokehead in a puff of sulphurous smoke’. The tribunal said Mr Longmuir should have been sacked for his bullying treatment of an employee.

After Mrs Lokhova made her claim against the bank, the false allegations of her being a drug addict were brought up, which made her ordeal all the more difficult. The tribunal ruled that it was bullying and deliberate misuse of the proceedings.

She was awarded £3.14 million for loss of earnings, £44,000 for hurt feelings and £15,000 in aggravated damages due to the false allegations made against her during the court case.

Accidents abroad claims with KLS Law – your specialist Warrington solicitors

As the summer months approach, thousands of UK residents will be booking their escape to more exotic climates. Unfortunately, accidents can happen anywhere, and at any time. It is vital to be precautious when holidaying in order to avoid an accident abroad, though sometimes an incident is completely out of your hands, leaving you injured and without liability.

This was the case for Alexandra Lees and her family after they were awarded a total of £20,000 in compensation after gastric illness ruined their holiday at an Egyptian Resort.

The family were staying at the four-star Tropicana Sea Beach Splash Resort in Sharm El-Sheikh when they all fell ill due to food poisoning via the resorts catering. Alexandra was awarded £12,000 after being put on medication for diarrhoea. Her father James was awarded £4,000 after developing pleurisy, a lung condition which causes severe chest pains. Her brother, stepmother and sister were awarded £1,900, £1,800 and £1,890 respectively.

First Choice, the family’s holidaymaker, denied liability however expert evidence was obtained to support the family’s claim. The resort responsible has since been removed from First Choice’s advertising.

An accident in a foreign country can be an intimidating experience with a multitude of issues. An injury might have to be addressed immediately, and it may be difficult to communicate with medical staff who’s first language is not English. There may be a mountain of arrangements to negotiate, but there are people who can help.

KLS Law and our team of specialist personal accident solicitors have over 25 years experience helping clients receive the compensation that they deserve.

If you have been the victim of an accident abroad and it wasn’t your fault, you may be entitled to claim.

Liability for Germanwings crash may still rest with Airline

The Germanwings air crash tragedy has been one of the most prominent news reports around the world recently, not least for the abject shock and sadness surrounding it. As well as this, the unusual circumstances of the crash have brought discussions of employers liability into the forefront. The Wall Street Journal has reported on these circumstances ensuring that the airline and it’s insurers will not necessarily be free from claims of negligence.

Germanwings parent company, Deutsche Lufthansa, will likely face huge liability claims despite the indications that co-pilot Andreas Lubitz deliberately crashed flight 9525 after hiding medical problems from his employer.

Investigations are still on going though it has emerged Lubitz was suffering from depression and was excused from duty on the day of the crash. He ignored the medical advice and flew anyway without informing the airline. Even though the airline were not to know of Lubitz medical problems, experts believe they will still face a huge task of proving they are not at fault.

Many will claim it failed to inadequately monitor its employee psychologically, resulting in all 150 people on board being killed. There is also the claim that they could have enacted the two-person cockpit rule that many others are adopting in the wake of the crash, a rule which may have possibly prevented the accident.

Under international law that governs commercial flying, families of victims are automatically entitled to receive around £100,000, however Lufthansa may well be liable for more than that. In the Journal’s report, specialist aviation personal injury lawyer Kevin Durkin states that families rights to make further claims are not waived by accepting those initial payments.

Lufthansa would not pay the legal costs itself, that would be down to it’s insurer, a unit of German company Allianz. Allianz were also the insurers of Malaysian airlines, which suffered two tragedies last year, and Air Asia flight 8501 which crashed in December.

Steven Marks, a partner at aviation litigation firm Podhurst Orseck stated that the size of the legal payments could depend on where the cases are filed. Payouts in Germany could be limited compared to those brought up in the United States, where it is easier to securer larger settlements.

The Journal’s report concludes that rules on what insurance airlines are required to carry vary by country, though it is standard to have third-party liability that covers payments for the loss of life or damage to others, regardless of who is at fault. Airlines typically hold insurance to cover the loss of a plane in accidents or through deliberate actions.

Bus driver awarded compensation after wrongfully accused of drug use

A bus driver who worked for First West England for 22 years has recently been awarded a significant amount of compensation after being wrongfully accused of taking cocaine.

Alan Bailes was asked to take a routine saliva test that returned a positive result for the class A drug. He was sacked from his job for gross misconduct as expected. However, Mr Bailes maintained his innocence and argued that the traces of cocaine must have come from contaminated banknotes that he had been handling as his role as bus driver.

He paid out of his own pocket for a more accurate follicle test with his GP that revealed there had in fact been no drugs present in his system for 90 days. Despite this proof, First West did not reinstate him.

Mr Bailes conducted his own research into how prevalent cocaine is in the circulation of banknotes (an estimated 88% contain detectable amounts), and also stated that on the day of the saliva test he had failed to wash his hands, giving way to the possibility that traces of cocaine may have transferred onto the swab.

First West of England acknowledged that they are aware of the fact many banknotes in circulation may be contaminated with cocaine. This means that as part of investigating whether how Mr Baines had tested positive for the class A drug, they should have looked into the banknote possibility as having some significance.

Industrial disease claims – Calls for reform on workplace compensation scheme

banner-industrial-disease

The STV reported today on a recent study carried out by researchers from Stirling University into the UK government’s workplace compensation scheme. The report described the scheme as “an unholy mess”, failing to compensate for thousands of cases where a person has developed an occupational disease.

It was found that such cases as lung cancer related to welding and breast cancer linked to shift work were among those not recognised by the scheme. The study questioned why these illnesses are not on the list for Industrial Injuries Disablement Benefit (IIDB) even though they are included in official cancer prevention priority rankings produced by the Health & Safety Executive (HSE) in 2012.

There are calls for immediate reform of the workplace compensation scheme as it only covers a small proportion of those made ill by their work.

HSE data reveals that there are almost 13,600 new cases of occupational cancer each year, yet in 2012 only 2600 were awarded compensation. The data also indicated that if asbestos related cancers were removed from the statistics, only 90 cases were compensated for.

“I am very pleased that your underwriters have been able to take a common sense view regarding my unfortunate accidents, rather than just a “computer says no” approach.

Once again you adopted a common sense and personal approach to your customers which is much appreciated. I had excellent service from all at the solicitors, who were successful in obtaining a bit more money from me, being the difference between the agreed value and the market value of the Thunderbird. I will certainly recommend you t o those in the classic car world, who I deal with regularly.”

Norfolk biker seeks £300k following road accident

A Norfolk man is battling for more than £300,000 compensation after suffering devastating injuries in a road crash.

Jamie Ireson, a 30 year old karate instructor, suffered life changing injuries when his bike was struck by a Land Rover on the A38, near Redruth, Cornwall.

During his post accident treatment complications arose and Mr Ireson had to have his left leg amputated below the knee.

As well as this, he sustained psychological scars and severe injuries to his left arm and wrist.

Due to the nature of his injuries he will require care for the rest of his life and will most likely have to give up his career in martial arts.

A writ lodged at London’s High Court states that Mr Ireson ended up being “catapulted” on to the road after the Land Rover emerged from a side road.
